I've made a workspace in 1.21 and found textures from vanilla minecraft inside the texture list when making a new item or block.
Microsoft/Mojang is able to sue you if this is not removed.
The textures are loaded dynamically from the MDG developed by NeoForge which utilizes vanilla resource endpoints to load them.
No textures are distributed or shared by MCreator when installing and/or downloading the software.
I think this is important distinction to be made

The thing is, it is still not legal to use the textures in your mod or resource pack if you will distribute it or share it with others
Downloading it for reference use is fine, distributing it to others and/or modifying most likely isn't, unless you get a direct permission for doing so
