No, you can't without their permission from a legal standpoint view and can theoretically get into trouble.

We allow you to use our template assets for your own needs ;)
you can actually use them in your mod but you cant distribute and make profit from it, i already contacted the Minecraft Community Manager about this
This is correct, but I assumed he wanted to distribute it (which means post it publicly) thus the reply. This is how it is in their terms of use.
if I understand correctly, we may use it in our mod it's legal and if you add it to the texture generator it isn't(because you are distributing your own software)?

No, you can actually distribute it, a lot of mods use Mojang's Texture out there, even famous mods use it
from what i understand you can use the textures for your own purposes but you cant distribute them and earn money of of it.

So why, if we can’t use Mojang assets, many of the biggest mods use Mojang textures to make ores (for example)? Because I’m pretty sure that they don’t make their own stone texture.
